1. Eligibility, agreement, and privacy notice
You may create an account only if you have the legal capacity to enter these Terms or, where applicable law requires it, valid parent or guardian permission. By creating an account, you agree to these Membership Terms. The Privacy Notice is provided for transparency and is not itself a request for consent; separate consent is requested where legally required.
2. Account security and lawful use
Keep account information reasonably accurate and protect your credentials. Do not impersonate another person, use the service unlawfully, infringe third-party rights, introduce malicious code, bypass access controls, interfere with security, or materially disrupt the service. You are responsible for activity performed through your account to the extent permitted by applicable law.
3. Your content and the limited service licence
You keep your rights in the goals, notes, session information, simulation content, preferences, and other content you submit. You grant Hyphocus only the non-exclusive, worldwide, royalty-free licence reasonably necessary to host, copy, transmit, display to you, back up, secure, and otherwise process that content to provide the functions you choose and operate the service. This licence does not transfer ownership of your content or create a right to sell your personal data. Hyphocus may use aggregated or genuinely de-identified information for security, statistics, and product improvement where re-identification is not reasonably possible and applicable law permits it.
4. Do not submit unnecessary sensitive information
Hyphocus is not designed to collect government identification numbers, payment-card data, passwords for other services, biometric identifiers, medical diagnoses, or other highly sensitive information in free-text fields. Do not place such information in goals, notes, nicknames, or similar fields. If a future feature requires a new sensitive-data category, Hyphocus will provide any additional notice, choice, or consent required by applicable law before that processing begins.
5. Service availability, changes, and pricing
Hyphocus may add, change, limit, or discontinue features for product, security, technical, or legal reasons. Reasonable notice will be given for material changes when practicable or required by law. Current free features do not authorize future charges. If paid features are introduced, pricing and any required purchase terms will be shown before a charge is accepted.
6. Suspension, termination, and account deletion
Hyphocus may restrict or terminate access for a material breach of these Terms, unlawful or abusive use, credible security risk, or legal requirement. Where practicable and legally appropriate, Hyphocus will provide notice or a reason. Users may request account deletion through the available account or contact channel. Termination does not remove rights or obligations that must continue by law.
7. No professional advice; warranties and liability
Hyphocus is a focus and productivity tool. It is not medical, mental-health, legal, financial, or educational professional advice and does not guarantee concentration, productivity, grades, health, income, or any other outcome. The service is provided on an “as available” basis and may contain interruptions or errors. To the maximum extent permitted by applicable law, Hyphocus excludes implied warranties that may lawfully be excluded and is not liable for indirect, incidental, special, consequential, or purely economic losses that the law permits to be limited. Nothing in these Terms excludes or limits liability or rights that cannot lawfully be excluded or limited, including mandatory consumer and data-protection rights.
8. Changes, mandatory rights, severability, and contact
Material changes to these Terms will be communicated in a reasonable manner. Renewed acceptance will be requested when the nature of the change or applicable law requires it. If one provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. No choice-of-law, forum, disclaimer, or other term in these Terms removes mandatory rights available to you under applicable law. 9. User responsibility and third-party rights
You are responsible for content and activity you submit or initiate through the service, including misuse, unlawful conduct, and infringement of third-party rights, subject to rights and limits that cannot be excluded under applicable law. You must resolve claims arising from your content or misuse where legally required, and must not use the service to harm others.
